ARTICLE 1- FIELD OF APPLICATION, DEFINITION AND OBJECT. The products described on the www.tuscanspirit.com site are realized and commercialized by the Termetour Srl company with a capital of 12,000 euros i.v. National Insurance No. and VAT Participation No. 01426700470 with legal and operational head office in Via Garibaldi 33, 51016 Montecatini Terme. Termetour Srl reserves the right to modify the Sales Conditions at any moment without warning. The modifications will not be retrospective.
Use of the www.tuscanspirit.com site, as well as the telephone service, entails total acceptance and without any questions on the part of the Client, the Conditions quoted in the following.
ARTICLE 2 – PURCHASE OF “TUSCAN SPIRIT” PACKETS ON SITE.
ARTICLE 2.1 – TERRITORIALITY.
However, for whatever controversy or difficulty of interpretation for the execution and ending of contract, all parties involved acknowledge to find a fair solution before proceeding with legal action .
ARTICLE 2.2 – LEGAL CAPACITY.
All clients who purchase or book, must formally declare to be of sound mind when purchasing or booking with www.tuscanspirit.com conforming with the Sales Conditions.
The client must declare to be financially responsible for the use of the site on his behalf and that of any third parties, including minors (children) under their care, apart from the possibility of demonstrating use was by fraudulent means and not by negligence. The instructions communicated to the client or third person who utilize this personal data will be considered true.
When and if the www.tuscanspsirit.com site is used and there is a violation of the present general conditions, refusal might be implicated by Termetour Srl with regards access of services of products on site, as with a refusal to confirm any booking.
ARTICLE 2.3 – PROCESS PHASE OF ORDERS AND STIPULATION OF CONTRACT
The client can book for whatever tourist service or packet available on the site with the following method:
° Directly on the www.tuscanspirit.com internet site only when Termetour Srl has accepted the booking request and within the expiry date indicated by Termetour.
° By means of telephone. Confirmation of the booking of services will be sent to the client after a verification of payment has been made, by means o fan e-mail contained in a rundown of the services booked and confirmed.
ARTICLE 3- PRICES AND PAYMENT CONDITIONS
The price of each service or packet, communicated by telephone to our offices or visualized on the www.tuscanspirit.com site, and indicated in Euros, can be subjected to time variations and are valid exclusively for the date visualized, also it only valid when the booking has been improved. The quote indicated are deemed to be confirmed at the moment in which the booking operation has been finalized with a booking number assigned. The booking and orders can be confirmed solely subject to the acceptance on the part of the client of the Conditions of Use and Sale; furthermore these will be confirmed following the correct and complete payment of prices of services booked.
The payment of services must be carried out using the following method:
a)Bank Transfer, sending the bank statement and confirmation of payment. Only the bank stamen and not a bank order constitutes a valid title for the payment confirmation.
b)by PAYPAL system
c)By Credit card without written authorization of the client and with cash card payment at our offices.
For the purchase of some particular services i.e. extra, you might be asked to pay by means of Credit Card, at the same time of booking, even when the booking has been made by telephone.
ARTICLE 4 – TRAVEL DOCUMENTS
The travel document (voucher) will be sent by e-mail after a verification by our offices of receiving payment of the entire sum. The client must print and bring the travel documents with him. The travel documents contain a lot of important information for the execution of the journey and should be checked and read with attention. In the event of incongruence found within the travel documents, the client must immediately contact an emergency number so that the error can be corrected. Eventual modifications brought about by technical error, when booking, will be communicated in writing before the departure and indicated within the travel documents.
ARTICLE 5 – BUYER AND BENEFICIARY DETAILS
The Client is expressly informed that apart from evident errors, all details memorized within our data bank are considered correct. It is the client’s responsibility to check that the address indicated for dispatch of travel documents is correct; Termetour Srl deny any responsibility for eventual non-delivery due to incorrect coordinates on the part of the buyer.
ARTICLE 6 – LEGAL RESPONSIBILITY OF USE OF www.tuscanspirit.com SITE
Occasionally an interruption in the service might occur on the site, due to improvements on the site itself. The responsibility of eventual problems caused by this, such as the incompatibility of the site www.tuscanspsirit.com with the client’s computer system, cannot in anyway be attributed to Termetour. If the client has any problems he should contact the emergency number.
ARTICLE 7 – VALUE ADDED TAX (VAT)
All invoices include VAT according to Article 74 TER DPR 633/72 and ulterior modifications and integrations.
ARTICLE 8 – CANCELLATION AND MODIFICATIONS
A cancellation request of total or partial and modification of the booking should arrive in our office by means of e-mail and should be re-confirmed by Termetour Srl with the sending of a bank statement with the eventual cancellation fees included.
If the same documents are not received the client is requested to verify the status of the paperwork by telephone. Confirmation of acceptance of the said Conditions of the presumed journey or whatever service purchased on the www.tuscanspirit.com site.
Modifications of the paperwork requested by the Client are always subject to re-confirmation without verification of the supplier’s availability and subject to an additional operational cover charge of Euro 20,00 for the paperwork.
ARTICLE 9 – ASSISTANCE
Termetour Srl guarantees an information and assistance service, during the journey, by means of a working telephone number for each day and that is indicated within the travel documents.
ARTICLE 10 – COMPLAINTS – CLIENT SERVICE
All complaints or whatever other type of communication or information requested should be sent, by registered post within 10 days of the re-entry to hotel and should be addressed to Termetour Srl, via Garibaldi 33, 51016 Montecatini Terme (PT) Italy.
ARTICLE 10.1 – DISABLED OR PEOPLE WITH ALLERGIES
The booking of bedrooms for disabled people should be made exclusively by explicit telephone communication. Information regarding services for disabled or bedrooms for disabled people within the hotel guide does not constitute in itself a guarantee that the said services or bedrooms are really available, as with the insertion of a note for the supply, during the booking phase does not constitute a guarantee of confirmation of the said service.
The booking of such bedroom typology should always be considered subject to re-confirmation as its availability at the hotel.
Likewise serious food problems, such as allergies to particular foods should be brought to attention during the booking phase. The warning will be forwarded to the hotel’s supplier services and restaurant if the meals booked are different from breakfast, but doesn’t constitute a guarantee to those affected by such pathologies, to which it will be asked a releasing of subscription which will dismiss Termetour Srl of whatever responsibility.
No responsibility will be assignable to Termetour Srl in the case of misunderstanding or inefficiency caused by the lack of or incomplete communication with regards to the above.
